Terms of Service

1. Who may use the Service

The Service is designed for families. The Service is intended to be set up and managed by a parent or legal guardian who is at least 18 years old. Children use the Service only under the supervision and direction of their parent or guardian.

The account holder must be an adult. By creating an account, you represent that you are at least 18 and that you agree to these Terms on behalf of yourself and any child you add to your family.

2. Your account

You sign in using a third-party identity provider (such as Apple or Google). You are responsible for maintaining the security of your account and for all activity that occurs under it, including your children's use.

You agree to provide accurate information (such as a child's grade or birth month and year) so that we can tailor practice appropriately, and to keep that information current.

3. What the Service does

Learnmoji helps children practice academic skills through short, guided practice sets. A parent describes what to practice, and the Service generates practice questions and hints, tracks progress, and awards in-app rewards such as stars.

Rewards, stars, streaks, and unlockable characters have no monetary value, cannot be exchanged for cash or anything outside the Service, and may change or be reset at any time.

4. AI-generated content

Practice questions, answers, hints, and related content are generated in part by automated systems and artificial intelligence. While we work to keep this content accurate, age-appropriate, and aligned to learning standards, it may occasionally be incorrect, incomplete, or unsuitable.

The Service is a supplemental practice tool, not a substitute for a teacher, curriculum, or professional educational advice. We encourage parents to review generated content and use their judgment. You use AI-generated content at your own discretion.

5. Acceptable use

You agree not to misuse the Service. In particular, you agree not to: use the Service for any unlawful purpose; submit prompts or content that are harmful, hateful, harassing, sexually explicit, or otherwise inappropriate, especially given that the Service is used by children; attempt to interfere with, disrupt, reverse engineer, or gain unauthorized access to the Service or its systems; or use the Service to develop a competing product.

We may suspend or terminate access that violates these Terms or that we reasonably believe risks harm to children, other users, or the Service.

6. Fees

Some features of the Service may be offered for a fee or by subscription. If you purchase a paid feature, the applicable price and terms will be disclosed to you before purchase, and purchases are processed by the app store you downloaded Learnmoji from, subject to that store's terms. Except as required by law or that store's policies, fees are non-refundable.

7. Intellectual property

The Service, including its software, design, text, graphics, and characters, is owned by Urple, LLC or its licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your family's personal, non-commercial use, subject to these Terms.

Content you submit (such as practice prompts) remains yours. You grant us a license to use it as needed to operate and improve the Service, as described in our Privacy Policy.

8. Third-party services

The Service relies on third parties, including identity providers, cloud hosting, and AI providers, to function. Your use of those features may also be subject to the third party's terms. We are not responsible for third-party services.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content will be accurate.

10. Limitation of liability

To the fullest extent permitted by law, Urple, LLC and its members, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or one hundred U.S. dollars ($100).

11. Indemnification

You agree to indemnify and hold harmless Urple, LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Service or your violation of these Terms.

12. Termination

You may stop using the Service at any time and may delete your account and its data from within the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as within the app. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Georgia will have exclusive jurisdiction over any dispute relating to these Terms or the Service, and you consent to venue there.
